Legal positivism maintains a distinction between law as it is and law as it ought to be. In other words, for positivists, a law can be legally valid even if it is immoral. H. L. A. Hart hoped to defend legal positivism against natural law. This paper analyses Hart’s criticism of Gustav Radbruch, a natural lawyer, before suggesting that Hart’s account of legal positivism gives rise to a logical problem. Is there ever any reason for a doctor to lie to a patient? In this paper, we critically review the literature on lying to patients and challenge the common notion that while lying is unacceptable, a related entity--'benevolent deception' is defensible. Further, we outline a rare circumstance when treating psychotic patients where lying to the patient is justified. This circumstance is illustrated by a clinical vignette.

ABSTRACT Generative artificial intelligence is transforming the way we make, and think about, art. With prompting from human users, these generative systems now produce aesthetically compelling and seemingly creative works in a variety of artistic domains. In doing so, they challenge the ways we think about artistic credit, about creativity, and about the mechanism of legal copyright, which is meant to protect and promote creativity in a capitalist art market. All of this is currently at play in the courtroom, as (...) artists contest the ways in which their artworks can be rightfully fed into these artificial systems (“the problem of the inputs”), and other artists are challenged over whether they might be credited for the visual images these systems generate (“the problem of the outputs”). Here, we explore these problems as they arise in visual art. We argue that the contested legal landscape surrounding these artificial systems reflects the ways they challenge our received notions of artistic credit and creativity. And we suggest that clarifying or changing the application of copyright in light of their generative capacities will ultimately involve revising our conception of art. (shrink)

Previous research has shown that the activation of a goal leads to more implicit positivity toward goal-relevant stimuli. We examined how the actual pursuit of a goal influences subsequent implicit positivity toward such stimuli. Participants were consciously or non-consciously primed with a goal, or not, and then completed a goal-relevant task on which they succeeded or failed. We then measured their goal-relevant implicit attitudes. Those who were primed with the goal (consciously or non-consciously) and experienced success exhibited more implicit positivity (...) toward the goal, compared with the no-goal condition. Experiencing failure in the goal priming conditions reduced implicit positivity toward the goal, indicating disengagement from the goal. We discuss the theoretical implications for understanding the role of implicit attitudes in self-regulation. (shrink)

Live donor kidney transplantation is the best treatment option for most patients with late-stage chronic kidney disease; however, the rate of living kidney donation has declined in the United States. A consensus conference was held June 5-6, 2014 to identify best practices and knowledge gaps pertaining to live donor kidney transplantation and living kidney donation. Transplant professionals, patients, and other key stakeholders discussed processes for educating transplant candidates and potential living donors about living kidney donation; efficiencies in the living donor (...) evaluation process; disparities in living donation; and financial and systemic barriers to living donation. We summarize the consensus recommendations for best practices in these educational and clinical domains, future research priorities, and possible public policy initiatives to remove barriers to living kidney donation. When people engage in conversation, they tailor their utterances to their conversational partners, whether these partners are other humans or computational systems. This tailoring, or adaptation to the partner takes place in all facets of human language use, and is based on a mental model or a user model of the conversational partner. Such adaptation has been shown to improve listeners' comprehension, their satisfaction with an interactive system, the efficiency with which they execute conversational tasks, and the likelihood of achieving (...) higher level goals such as changing the listener's beliefs and attitudes. We focus on one aspect of adaptation, namely the tailoring of the content of dialogue system utterances for the higher level processes of persuasion, argumentation and advice-giving. Our hypothesis is that algorithms that adapt content for these processes, according to a user model, will improve the usability, efficiency, and effectiveness of dialogue systems. We describe a multimodal dialogue system and algorithms for adaptive content selection based on multi-attribute decision theory. We demonstrate experimentally the improved efficacy of system responses through the use of user models to both tailor the content of system utterances and to manipulate their conciseness. (shrink)

One way to detect, monitor and prevent adverse events with the help of Information Technology is by using ontologies capable of representing three levels of reality: what is the case, what is believed about reality, and what is represented. We report on how Basic Formal Ontology and Referent Tracking exhibit this capability and how they are used to develop an adverse event ontology and related data annotation scheme for the European ReMINE project.

Professor Foxall suggests the radical behaviorist language of contingencies is fine as far as it goes, and is quite suitable for matters of prediction and control. However, he argues that radical behaviorist language is extensional, and that it is necessary to formally incorporate the intentional idiom into the language of behavioral science to promote explanations and interpretations of behavior that are comprehensive in scope. Notwithstanding Professor Foxall's arguments, radical behaviorists hold that the circumstances identified by the use of the intentional (...) idiom are accommodated by the radical behaviorist language of contingencies, not only for prediction and control but also for explanations and interpretations. Of central importance is that individuals may have histories that lead them to generate descriptions of past and present behavior, as well as descriptions of prevailing circumstances that have caused that behavior or are likely to cause that behavior in the future. The resulting verbal behavior may then enter into contingencies influencing their behavior, although the extent to which it does so varies across individuals as a function of their histories. Overall, the way that the pragmatism of radical behaviorism conceives of the nature and contribution of covert events differs appreciably from the way Professor Foxall conceives of the nature and contribution of intentional phenomena. The present article is the first in a series of three that outlines the historical and conceptual background of B.F. Skinner’s radical behaviorism. The series seeks to identify milestones in the development of Skinner’s position, as well as assess the impact of particular factors and events on Skinner himself. Of special interest in this article are the biographical details of Skinner’s life between June, 1926, when he received his undergraduate degree, and September, 1928, when he entered graduate school. The article (...) also examines the intellectual climate at the start of the second quarter of the twentieth century that led Skinner to become interested in the empirical study of behavior. Overall, Skinner’s views during this period were significantly influenced by such literary figures in the modernist tradition as H.G. Wells and Sinclair Lewis; and such scientific/philosophical figures as Francis Bacon, Jacques Loeb, Ivan Pavlov, Bertrand Russell, and John B. Watson. (shrink)

Barresi & Moore assume an equivalence between ontogenetic and evolutionaiy transformations of social understanding. The mechanisms of evolution allow for novel structures to arise, both through terminal addition and through the onset of novel pathways at time points that precede the end points of ancestral pathways. Terminal addition may not be the appropriate model for the evolution of human object-directed imitation, intermodal equivalence, or joint attention.

G. E. Moore, unlike most prophets, is honoured only in his own country—the small world of the Aristotelian Society and the Cambridge Moral Science Club. To outsiders he is known, if at all, mainly because of his connection with his more flamboyant colleagues, Russell and Wittgenstein. Yet Moore’s influence on the intellectual life of this century is hardly calculable. Philosophy as it is now taught in the universities of the English–speaking world derives its character, largely, from his personal (...) habits of thought. He bequeathed it its most obvious and, to the layman, most irritating characteristics—the emphasis on linguistic analysis and the tendency to avoid the really important problems, the problems which determine our way of life. Contemporary English philosophy is, like Moore’s, a philosophy of common–sense. It is concerned, not so much with truth but with meaning, the meaning of those statements whose truth is guaranteed by common–sense; hence arise the method of linguistic analysis and the failure to tackle those problems which common–sense cannot answer. RRecently, much work has been done on G.E. Moore’s proof of an external world with the aim of diagnosing just where the Proof ‘goes wrong’. In the mainstream literature, the most widely discussed debate on this score stands between those who defend competing accounts of perceptual warrant known as dogmatism and conservativism. Each account implies a different verdict on Moore’s Proof, though both share a commitment to supposing that an examination of premise-conclusion dependence relations will sufficiently reveal what’s (...) wrong with the Proof. Parallel to this debate on Moore stands perhaps an equally interesting debate within which the Proof is critiqued as it stands in the context of the skeptical debate. On this score, Michael Fara and Ernest Sosa have weighed in with a markedly different take on Moore’s anti-skeptical ambitions and on the nature of skeptical challenges more generally. The aim of this paper will be to critically evaluate these two very distinct strands of recent work on Moore’s Proof. Part I of the paper will focus on the mainstream debate, and in Part II of the paper, I’ll focus on the parallel debate about skepticism. My critical discussion will be aimed throughout at showing how the various proposals I’ve taken as representative of these two parallel debates surrounding Moore’s Proof ultimately fall short—each for different reasons—of what a satisfactory diagnosis of the Proof would require. This book evaluates Moore's contribution to the discussion of a number of epistemological problems, and arrives at the conclusion that Moore's contribution is not considerable. The author maintains that Moore was able to succeed philosophically in the refutation of Idealism, in the establishment of analytical techniques, and in his recognition of the role of common sense; but in those technical areas which were most interesting to Moore, the author finds little accomplishment, and even some confusion. For (...) example, in considering the problem of the relation between perception and an external world, Moore defends the common sense notions, but only on common sense grounds. The external world, which we know to exist with a high degree of certainty according to our common sense, we do not know to exist with any certainty at all when we approach the problem through an analysis of sense perception; and Moore will only say that we do not know that we do not know that external objects exist. Concerning the problem of truth and falsity the author finds Moore constructive but in need of revision and reconstruction, which the author obligingly attempts where necessary. Moore's position with respect to meaning and analysis is also evaluated with the same critical eye. Finally, the author shows the relative positions of common sense and ordinary language in Moore's thought.--J. J. E. (shrink)
